COMPENSATORY COURT CLAIM / CIVIL SUIT PENDING
I contracted with Aero Moto Training LLC for private pilot lessons last September where I paid 7500 dolalrsto Kurt Schneider the company owner. My wife had passed away last May of cancer and she made me promise before she died that I would get my pilot license. Her name was Kathryn J Sanborn and was a Naval officer, her father Naval Doctor for 30 years and her brother a Naval Pilot for 20 years. After 4 flight lessons and 1 class my leg and back began having extreme pain from the pilot seat. For 5 months I underwent physical therapy and various doctor appointments.
Mr. Schneider was informed of my condition and I intended to return by year end last year but my condition worsened. Two weeks ago I met with Mr. Schneider who told me he would give me a statement of my account (for which he has been paid), my flight log book and a refund. By the end of the first week of delaying me he informed me he does not have the money. With frustration I told him I intended to sue him if I do not receive a refund and in any event I wanted a copy of my statement of account and pilot log.
He continued to tell me he would get this information but has never done so. I contacted the FAA inspection department who were very upset with his behavior and recommended I also demand a copy of the "CAN" which are the safety and maintenance records they require be kept for each flight. Again I demanded this information and Mr. Schneider says he will get it to me all this past week but still has not done so.
On Monday I plan to file suit again Aero Moto Training LLC and the company that leases the plane to him as he claims he paid them 5400 dollars on my behalf and has requested a refund but they have not responded. The name of that company is Hotel Echo Inc and is owned by Mr. Wayne S Jackson of 17 Willow Trace Flagler Beach, Florida 32136. The tail number of the plane is N777HE, the HE meaning Hotel Echo.
I would appreciate anything you can do to help me obtain my refund. My doctor has declared me permanently disabled and even though I have repeated text to and from Mr. Schneider assuring him I will not sue if he provides with me accurate information and we can reconcile and continue training. If not, then I demand a refund. Mr. Schneider actually tried to tell me because I had not contacted him recently I should not expect anything else. In all actuality he was to provide me with statements each month. Each time I am in his office and request he print the statement he claims something is wrong with the computer.
The two items required are a copy of the "CAN" and the account statement which must reconcile. This would take he or his assistant no more than 15 minutes and I have told them I will pick it up, they can text, email, mail, or bring it to me at their option. Yet Mr. Schneider will simply not comply while saying he will comply.
You should also know that in June 2016 a tax lien of dollars 726 by the Florida Department of Revenue placed on the business according to local newspapers.
Thank you for your time and consideration. Local TV and newspapers have agreed to investigate this matter along with the Sheriff and the Better Business Bureau. The next step is to complete many more of these websites and link them together and then file litigation.
