On August 19, 2009, Harpo, Inc., producers of The Oprah Winfrey Show and The Dr. Oz Show, along with Dr. Mehmet Oz, filed a trademark infringement complaint against 40 Internet marketers of dietary supplements, including acai berry products among others.
Neither Ms. Winfrey nor Dr. Oz has ever sponsored or endorsed any acai berry, resveratrol, colon cleanse or dietary supplement product.

Harpo, Inc. has filed this lawsuit to let consumers know that these internet marketers are willfully using the names of well-known figures to deceive the public. Neither Ms. Winfrey nor Dr. Oz has ever sponsored or endorsed any acai, resveratrol or dietary supplement
product and cannot vouch for their safety or effectiveness. It is our intention to put an end to these companies' false claims and increasingly deceptive practices.

"The companies that are using my name to hawk these products are duping the public. I do not endorse any of these products. By falsely presenting products as 'scientifically proven' and endorsed by well-known figures, these companies do a gross disservice to the

The economy is bad and Las Vegas has had one of the highest unemployment rates in the country. Some people in Las Vegas find a way to make money no matter what the cost or who is getting fleeced. Las Vegas is filled with these type of people that live on the
fringes of the communitie's working class. The Vegas phone room jobs have always been a hotbed for scams over these past few are no different. the product or service is changed but the misleading tactics stay the same.

One of the newest types of phone room/internet scams is the "ACAI BERRY" health scam. Many of the boiler room operators have jumped on the band wagon to scam innocent elderly seniors to buy the overrated dietary supplement SNAKE OIL. Many of these types
of boiler room operations are made up of the same telemarketers that sold another snake oil called "HGH" spray/sublingual form.

Many of the people who work on the phone for these type of boiler room operations are taught to sound/pretend as if they know about the various medical conditions (Diabetes, Cancer, Weight Loss, Macular Degeneration, Thyroid Disorders, Alheimers,
Blood Pressure, Weight Loss etc) they will go through a full barrage of questions as if to verbally diagnose the unsuspecting senior on the phonE. Many of the boiler rooms nationwide tell the victims that they will be counseled or to call one of their nutritionist if they purchase it by credit card over the phone. 99% of the time, the so called nutritionist is NOT certified or registered as a nutritionist. They're usually just a person that is employed to sell more or "upload" more to the unwary victim.

The truth is that the FDA does not recognize or endorse the Acai Berry. IT'S JUST ANOTHER DIETARY SUPPLEMENT. > THATS ALL IT IS, BUT MANY OF THE TELEMARKETERS TRYING TO SELL THIS STUFF NATIONWIDE DON'T MENTION
THAT TO THE UNWARY ELDERLY CONSUMER.

Allegation: False endorsements
Some CCN products carry endorsements by Oprah Winfrey and Rachel Ray. How can you go wrong with a product endorsed by these trusted celebrities? Well, it turns out those endorsements were bogus. Rachael Ray provided the FTC with this sworn statement: "I have never approved or agreed to the use of my name or my image in conjunction with the sale and marketing of AcaiPure, or any acai berry-related product."
